Description:

NOTICE IS HEREBY GIVEN that the City of Hesperia will receive online sealed bids on or before 11:00 a.m. on December 5, 2023 via the “PUBLIC|PURCHASE” web site for the construction of City Hall Minor Tenant Improvements – IT Office, C.O. No. 3110-2301. Bids will be opened and publicly read immediately thereafter in the Desert Willow Conference Room.

Project Description: This project consists of the construction to modify one area on the second floor of Hesperia City Hall to add one (1) new office space with office furniture, temporary cubicle relocation, and cubicle reconfiguration. The project includes all required modifications to existing facilities required to accommodate the new construction, such as electrical, mechanical, heating ventilation/air conditioning, lighting, specialties, etc. All work required to construct the improvements, as generally described on the project plans, and cubicle modifications be complete, in place, and fully functional and operational, shall be included. The estimate of probable cost for this project is $50,000 to $75,000 and the time for completion of the Work shall be ninety (90) calendar days.

The work is to be done in accordance with the Contract Documents and Specifications and the Plans on file in the Development Services Department of the City of Hesperia, which are also available online via the PUBLIC|PURCHASE website, and as directed by the Building Official.

A VOLUNTARY PRE-BID MEETING will be held at 11:00 a.m. on Tuesday, November 21, 2023 and will be conducted in the Desert Willow Conference Room at Hesperia City Hall located at 9700 Seventh Avenue , Hesperia, California.

The Contract Documents and Specifications and Plans for this project are available for download online through the PUBLIC|PURCHASE website, which can be accessed via the City of Hesperia Website at http://www.cityofhesperia.us/CivicAlerts.aspx?AID=331 or via the PUBLIC|PURCHASE website directly at www.publicpurchase.com. Bidder registration is free. Bids shall be submitted in conformance with and on the forms (which shall be entitled “Bid Forms”) that are provided online by the Development Services Department of the City. The Bid Forms for this project are available for download through the PUBLIC|PURCHASE website. No bid will be considered from a contractor who has not downloaded, completed, and then uploaded ALL of the completed Bid Forms to the PUBLIC|PURCHASE website, which is utilized by the City of Hesperia for bidding of public works projects. Hard copies of Bid Forms will no longer be accepted.

PUBLIC WORKS CONTRACTOR AND SUBCONTRACTOR REGISTRATION: Pursuant to California Labor Code Division 2, Part 7, Chapter 1, Article 2, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work with the City of Hesperia, as defined in said chapter, unless currently registered with the California Department of Industrial Relations and qualified to perform public work pursuant to Labor Code § 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code § 1771.1(a)]. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by § 7029.1 of the Business and Professions Code or by §§ 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work at the time the contract is awarded.

All Contractors and Subcontractors performing work on this project shall be required to furnish electronic certified payroll records directly to the Labor Commissioner (i.e., California Department of Industrial Relations - Division of Labor Standards Enforcement). The awarded Contractor shall post jobsite notices as prescribed by regulations.

All Bidders and their subcontractors (that are listed on – List of Proposed Subcontractors or Sub-Tier Contractors) shall provide an extract from the Public Works Contractor Registration web site with their submitted bid providing evidence of active registration with the Labor Commissioner.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

NOTICE IS HEREBY GIVEN that this project is a public work in the State of California, funded in whole or in part with public funds. U nder the provisions of California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the contractor and any subcontractor under the contractor is required to pay not less than the general prevailing rate of per diem wages to all workers employed in the performance of work under this project for work of a similar character in the locality in which the public work is performed, including the general prevailing rate of per diem wages for holiday and overtime work. The Contractor’s duty to pay State prevailing wages can be found under Labor Code § 1770 et seq. Pursuant to § 1773 of the Labor Code, the Director of the California Department of Industrial Relations (DIR) has determined such general prevailing rates of per diem wages. The same are on file at the Development Services Department of the City of Hesperia, 9700 Seventh Avenue, Hesperia, California, and are available to any interested party upon request; or may be obtained online from the DIR website at http://www.dir.ca.gov. The contractor shall cause a copy of said determinations to be posted at the job site. The contractor shall be subject to the penalty forfeiture provisions of the Labor Code for violations by the contractor or any subcontractor under him. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The State Wage Decision is on file at the Development Services Department, and is also available online at http://www.dir.ca.gov/dlsr/ .

Labor Code §§ 1775, 1777.1 and 1777.7 and Cal. Pub. Contract Code § 6109 outlines the penalties for failure to pay prevailing wages and to employ apprentices, including forfeitures and debarment. Any bid submitted by a contractor or subcontractor that is ineligible to bid on a public work pursuant to these codes shall be rejected. The California Department of Industrial Relations publishes a list of debarred contractors online at http://www.dir.ca.gov/dlse/dbar.html

For purposes of Labor Code § 1781, this Project is a “public work” to which Labor Code § 1771 applies, and the Contractor and all listed or unlisted subcontractors must perform the work as a “public work.” The Contractor has the responsibility for determining what is required to comply with its obligations under Labor Code § 1771. Any decision by the Contractor or any listed or unlisted subcontractor not to comply with Labor Code § 1771 is at the sole risk of the Contractor or subcontractor.

ELECTRONIC CERTIFIED PAYROLLS are required to be submitted during the term of construction. Payment of contractor’s invoice may be delayed when certified payrolls are not submitted in accordance with the California Labor Code. The City shall make progress payments on any properly completed payment request submitted by the Contractor. The payment request shall not be deemed properly completed unless certified payrolls have been properly completed and submitted on a monthly basis, for each week worked during the time period covered by said payment request.

APPRENTICESHIP PROGRAM: Attention is directed to §§ 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices. In accordance with §§ 1777.5 and 1777.6 of the Labor Code, as amended, and the regulations of the California Apprenticeship Council, properly indentured apprentices may be employed in the prosecution of the work. Attention is directed to §§ 1777.5 and 1777.6 of the Labor Code concerning the employment of apprentices by the Contractor or any subcontractor under him/her.

WORKING HOURS: The Contractor and any subcontractor under him/her shall comply with and be governed by the laws pertaining to working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code, as amended. The Contractor shall forfeit, as a penalty to the City of Hesperia, $25.00 for each laborer, workman, or mechanic employed in the execution of the Contract, by him/her or any subcontractor under him/her, upon any of the work herein before mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor more than 8 hours in violation of said Labor Code. Contractor shall pay travel and subsistence pay pursuant to Labor Code § 1773.8.

BIDDERS MUST SUBMIT , in the form of cash, a cashier’s check, a certified check, or a bidder’s bond, payable to the City of Hesperia in an amount equal to at least ten percent (10%) of the bid, as a guarantee that the Bidder will enter into the contract if the same is awarded to the successful bidder, and in event of failure to enter into such contract said cash, cashier’s check, certified check, or bond shall become the property of the City of Hesperia. If the City of Hesperia awards the contract to the next lowest Bidder, the amount of the lowest Bidder’s security shall be applied to the difference between the low bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest Bidder.

The three (3) apparent lowest bidders shall submit their original wet-signed bidder’s bond, or other form of original bidder’s security, to the City either in person or via U.S. Mail within three (3) working days after the date of the online bid opening. Failure of any of these bidders to submit an original of their bidder’s security within the stipulated deadline shall be cause for rejection of their bid.

The successful Bidder shall be required to post a Performance Bond in the amount of one hundred percent (100%) of the contract price and a Payment Bond (Labor and Materials Bond) equal to one hundred percent (100%) of the contract price. Sureties shall meet all of the State of California bonding requirements in accordance with the Code of Civil Procedure (§ 995.120) and be admitted by the State of California.

Except as required by California Public Contract Code § 20103.5 - Federal Funded Projects, no bid will be considered from a contractor who is not licensed at the time of bid opening as a Class B: General Building Contractor.

The contractor may, upon request and at the sole expense of the contractor, substitute authorized securities in lieu of monies withheld (performance retention) by the City.

The successful bidder will be required to enter into a contract satisfactory to the City of Hesperia. The City reserves the right to reject any or all bids or any part(s) thereof, to waive any irregularities or informalities in any bid or in the bid process, and to make a contract award in the best interest of the City.
